These Rules & Regulations (“Rules”) intend to provide the maximum use and enjoyment of the Facilities by the members and their guests. The enforcement of these Rules lies primarily in the hands of VIV Athletic Club management whose principal responsibility is to assure members of all the courtesies, comforts and services that we provide. It is also the duty of the members to know the Rules and to cooperate with VIV Athletic Club management in their enforcement. The Rules may be revised, amended, supplemented, modified or repealed by VIV Athletic Club management at any time, and without prior notice. In addition, VIV Athletic Club management will have any number of operating policies and procedures necessary for the overall efficient and effective management of VIV Athletic Club. Violation of the Rules may result in a reprimand, suspension or expulsion. VIV Athletic Club shall have the unqualified right to make such Rules, as it deems necessary or appropriate. The Rules shall be available to members upon request.
Hours of Operation & Closures: Operating schedules will be subject to change from time to time, according to notices posted at the gym. VIV Athletic Club may suspend or limit your access to certain areas, features or amenities. VIV Athletic Club may be closed on holidays, for emergencies or for major repairs, and hours may change at VIV Athletic Club’s sole discretion.
Front Desk: No one is permitted in the employee-only areas, including without limitation, behind the front desk, the offices or the break rooms except gym personnel.
Unpaid Balances: Members will not be permitted to use the Facilities until all dues and fees are current. Members are obligated to pay any collection and/or legal costs incurred by VIV Athletic Club for collection of any fees. VIV Athletic Club reserves the right to charge balances and overdue balances to their current account under the Automatic Re-Occurring Payment Authorization.
Update Member Records: All members will promptly notify VIV Athletic Club of any changes to the member’s information provided on the member’s Membership Agreement, including, but not limited, billing information, current mailing address, employer information and emergency contact information.
Freeze Policy: A For members with a 1-Year Term Plan, the member may request in writing that his/her entitlementthe member’s access to use the Facilities under the Membership Agreement be put on hold. For your convenience, requests may be emailed to our billing department at billing@vivathleticclub.com or submitted online at https://www.vivathleticclub.com/membership-freeze Memberships must be frozen in 30-day increments (a “freeze period”), in the case of a 1-Year Term Plan only.”) and cannot exceed 90 days (a “maximum annual freeze period”), in the case of a 1-Year Term Plan only.”). For good cause shown by member, and if member is not in default under the Agreement, VIV Athletic Club willmay extend member’s entitlementaccess to use the Facilities a like time as anyfor the requested freeze period granted. During any freeze period, all terms of the Agreement continue in full force and effect, including the member’s payment obligations. A monthly administrative fee of $25.00 will be assessed for each month during the freeze period. The effective date of any freeze or cancellation requested shall be 30 days from VIV Athletic Club’s receipt of written notice or email from the member. Following a freeze period, your term membership expiration date will be extended by the total amount of days that your membership was frozen.
Additional Programs, Services and Group Instruction: VIV Athletic Club may provide, in its sole discretion, programs (such as dance exercise programs etc.), services (such as red-light therapy or cryotherapy) or equipment related to physical fitness. We shall not be required to continue any particular programs, facilities, services, or equipment related to as part of its contractual obligations here under and may discontinue, change, or modify the same in its sole and absolute discarding, without recourse by the member.
Signing In / Membership Card: All members upon entering the gym shall be required to scan their membership card in at the front desk. All guests are required to print and sign their names in the guest registry, and must leave an ID at the front desk while using the facility. Members and guests may be required to furnish other suitable identification as requested by gym personnel in order to gain entrance. In the event that a member claims that his or her membership card has been lost, stolen or destroyed, the replacement cost will be $10.00. Member shall be responsible for surrendering his or her membership card on or before the last day of membership or upon termination or cancellation of membership.
Complimentary Guest Pass / Guest Fee: VIV Athletic Club may provide a complimentary guest pass to any member in good standing. If provided, this pass will entitle one person of the member’s choice 1 free visit, provided, however, that the same guest may not come in as a free guest more than once in any 6-month period. A guest may accompany a member without the limitation of 1 visit per 6-month period by paying a guest fee of $20.00 for each visit, and this guest fee may be subject to change from time to time.
Day Use Fee: A non-member that is not a guest of another member may use the gym by paying a day use fee of $29.00, which amount may be subject to change.
Time Limits on Equipment: There are no time limits on machines or equipment. However, members and trainers will be required to either limit their time oror allow another members to work in with them if asked. Trainers working out on their own are required to give priority to members and other trainers with clients.
Equipment Malfunctions: You understand that equipment may, from time to time, be out of order. When special factory parts must be ordered, some units may be out of order several days or weeks. If you experience or observe a malfunction on a piece of equipment, please report such occurrence immediately to gym personnel and stop use of the equipment immediately.
Treadmill Safety: You shall not start a treadmill until you are in the proper position, and you will not leave the treadmill running while unattended.
Injuries: In case of an accident, you will inform gym personnel immediately. If You become injured, you should seek the professional assistance of a licensed physician immediately and refrain from any physical activity until such activity is approved by your physician. An incident report must be completed if circumstances permit.
Children: VIV Athletic Club does not provide Childcare. Any person under 18 years of age must be accompanied by a parent or guardian and must have a parental release signed. Children under 14 are not permitted in the workout areas or locker rooms.
Exercise Clothing: Proper athletic attire and footwear required. No street clothes or dress shoes permitted in fitness area. VIV Athletic Club has the right to prevent the use of any equipment if the proper attire is not worn. Cutoffs, jeans, and clothes with buttons, buckles or zippers are prohibited. Open-toed sandals and flip-flops are only allowed in locker rooms, showers or steam rooms.
No Foul Language or Fighting: Foul language, fighting or offensive attitudes towards other members or staff will not be tolerated.
Conduct of Members: All members will be subject to the control and guidance of the gym staff while in the Facilities. All Members are expected to conduct themselves in a quiet, well-mannered fashion while in the Facilities and save all criticism or comments of any major kind about other gym members, guests, or gym personnel until in a private office with the gym manager. No harassment of any nature will be tolerated. Inappropriate behavior will not be tolerated, and management will take action against such conduct which shows lack of respect for others or which leads people to feel threatened.
Mobile Phones: All members are prohibited from using cellular and mobile telephones in the workout areas and locker rooms.
Filming: To protect the privacy of our members and guests, filming is prohibited on premises without express written prior authorization from management.
Personal Hygiene: All members will maintain personal hygiene and use deodorants, towels etc. Proper personal hygiene must be maintained by showering regularly, wearing clean clothing, and using deodorant. Please be courteous to others by observing proper regular hygiene and limiting use of perfumed sprays, fragrant lotions, or colognes as they may be offensive to others. Members or trainers with persistent body odor violating this provision may be required to leave the facility.
Equipment: Weight plates, dumbbells and all loose equipment must be put back in their proper place after each use. Do not lean any weights against the equipment, against the wall, or lay them on the floor. All members and trainers shall be required to wipe down their machines after use. Spray stations are available throughout the gym.
Towels: All members must use towels while training and exercising in the Facilities. Towels are available at the front desk. Towels are the property of VIV Athletic Club. Members and guests will be charged for towels removed from the facility.
Lockers: Lockers are for day use only, and VIV Athletic Club will discard the content of all lockers on a nightly basis, including the removal of any locks. All members will furnish their own lock, and will not use lockers without the use of a lock. No food is allowed in locker rooms.
Personal Property: VIV Athletic Club is not responsible for and shall not be liable for the loss of or theft of, or damage to the personal property of members or guests, including items left in lockers or anywhere else in the Facilities. No gym bags are allowed on the floor or in exercise areas.
No Pets or Animals: Unless otherwise expressly required by law, all animals are prohibited in the Facilities.
Food and Beverage: No food, chewing gum or coffee is allowed on exercise floor. Only water or sports drinks are allowed in exercise areas. Alcoholic beverages are strictly prohibited. Glass containers are strictly prohibited.
Smoking: VIV Athletic Club is a smoking and tobacco free area. Smoking is strictly prohibited in all areas of all Facilities.
Illegal Drugs: VIV Athletic Club is a drug free area. Any and all illicit substances, the use of illicit substances and the sale of illicit substances in the Facilities is strictly prohibited. Report any illicit substances or suspicious activity to the management of VIV Athletic Club.
Chalk and Powder: No chalk or powder is permitted in the workout area.
Weight Belts: Weight belts must be worn or removed while using some equipment. Please obey all posted signs.
Personal Trainers: Personal trainers are prohibited from training clients in the Facilities unless expressly authorized by VIV Athletic Club in writing. No personal trainer is permitted to solicit, approach or otherwise disturb any member of VIV Athletic Club.
