The following policies apply to all members, guests, vendors, and visitors of VIV Athletic Club ("VIV," the "Club"). These guidelines help ensure a safe, respectful, and exceptional experience for everyone — please read them carefully. Under your Membership Agreement or other agreement and/or terms required to gain entry to the Club, and/or by your use of any VIV facility, you are responsible for complying with all VIV policies, including those outlined in this document. VIV reserves the right to enforce these policies at its discretion and may suspend or terminate your access for violations.
ACCESSING THE CLUB
Check-In
You are required to check in at the front desk upon entry to the Club and display your mobile app barcode or other access and identification method made available by VIV. If you leave and re-enter the Club, you must check in again at the front desk.
Identification
You may be required to maintain a photo and copy of your photo identification on file with VIV in order to verify your identity before entering the Club. If you do not have a photo on file, you must present photo identification at the time of each check-in.
Good Standing
You may be prohibited from accessing the Club if there are any outstanding past-due or overdue amounts payable to VIV, or if your membership is otherwise not in good standing.
Compliance with Club Hours
You are required to comply with the Club's posted hours of operation and any additional instructions provided by VIV staff. Use of the Club must cease in advance of closing, and you are required to fully vacate the premises by the designated closing time, or earlier if instructed by VIV.
CONDUCT & BEHAVIOR
Personal Conduct
Members and guests must treat all individuals with respect and maintain appropriate behavior at all times. Harassment, threats, discrimination, aggressive conduct, or other disruptive behavior toward members, guests, or staff will not be tolerated and may result in removal from the Club or termination of membership.
VIV upholds its team members to the highest standards of professionalism and expects the same in return. If you make any inappropriate or sexually suggestive remarks or advances, your services, sessions, and/or membership will be terminated immediately. VIV may, in its discretion, permanently terminate your membership or ability to access the Club, or take other action it deems appropriate. Permanent termination constitutes a lifetime ban from VIV Athletic Club and prohibits any future re-enrollment.
Inclusivity
VIV Athletic Club strives to provide a supportive, respectful, and inclusive environment for all members, employees, vendors, and guests. We expect everyone in our Club to uphold these same values.
Weapons
Firearms and other weapons of any kind are prohibited at VIV Athletic Club to the fullest extent permitted by applicable law, regardless of any permit, license, or authorization to carry. For purposes of this policy, "weapons" include firearms, knives, and any other item intended to cause harm or that could reasonably be used as a weapon.
Any individual who brings a weapon onto Club property may be asked to immediately remove the item from the premises or leave the Club. Failure to comply may result in removal from the premises, suspension or termination of membership, and any other action permitted by law.
Restricted Substances
VIV Athletic Club is drug-free and smoke-free, including vaping. You are expected to help maintain a safe and healthy environment. Use of any Club facility or service — including equipment, personal training sessions, recovery services, events, activities, and other programs — is strictly prohibited while under the influence of any substance that impairs your safe participation.
If alcohol is offered by VIV or an approved vendor, you must be at least twenty-one (21) years of age with valid identification to consume alcohol. Alcohol must remain in designated areas, and use of Club fitness or recovery facilities after consuming alcohol is not permitted.
RECORDING, PHOTOGRAPHY & DEVICES
Cell Phone, Camera, and Other Device Use
Recording or photography is strictly prohibited in all private areas, including locker rooms, saunas, steam rooms, recovery rooms, red light therapy rooms, hyperbaric oxygen chamber rooms, and during group fitness classes. Photography in other areas of the Club is permitted only for personal use and must not capture other members, guests, or staff without their permission.
Photography or recording for commercial purposes, including promoting personal businesses or services, is not permitted. Lighting equipment, tripods, or other professional equipment are not allowed. You may be asked to remove content that captures another individual without their permission.
Personal Media Use
As a courtesy to others, all audio and video content must be played through headphones at all times. Volume must remain inaudible to others to ensure a respectful environment. Video or voice calls are prohibited in all private areas, including locker rooms, saunas, steam rooms, recovery rooms, and during group fitness classes. Voice and video calls may be taken in lounge or lobby spaces as long as they are not on speaker mode or disruptive to others, as determined by VIV in its sole discretion.
LOCKER ROOM & SERVICES
Locker Room Access
All individuals are welcome to use the locker room associated with the gender they identify as or with which they feel most comfortable, except as prohibited by state or local law. Any person who prefers more privacy may use a single-occupancy restroom, if available.
Lockers
Lockers are provided solely for your benefit and convenience during your visit; availability is not guaranteed. You are responsible for locking your locker and may be required to provide your own lock. Storage of illegal substances in any locker is strictly forbidden.
To the maximum extent permitted by law, VIV Athletic Club will not be liable for the loss or theft of, or damage to, any personal property left in any locker.
VIV reserves the right to search any locker without notice in its sole discretion.

Daily Lockers: VIV will remove and discard any articles left in a locker overnight.

Overnight Lockers: Certain lockers may be available for rent for an additional, non-refundable fee or as a member benefit in your membership tier. Overnight lockers included in your membership tier will terminate if you downgrade your membership.
Sauna
You are expected to maintain a respectful environment in the sauna. Cell phones, cameras, recording devices, electronic devices, used workout clothing, grooming products, and food are not permitted in the sauna.
Shower, and Sauna Scheduled Closures
Showers and saunas may be closed at certain times for routine maintenance. Signs may be posted or team members may notify those in the area of scheduled closures. Showers close fifteen (15) minutes prior to Club closing; plan accordingly. Entry to the showers will not be permitted during the final fifteen (15) minutes before closing.
USING THE CLUB
Dress Code
You are required to wear appropriate athletic attire, including a top and footwear, when in the Club, using any equipment, or participating in any group fitness class, training session, or other activity. In certain group fitness classes such as yoga, the instructor may require you to remove footwear as a condition of participation.
Appropriate swimwear is required to use any pool, cold plunge, hot tub, or hydrotherapy amenity, consistent with applicable state and local regulations. VIV may deny you use of the Club if you do not wear proper attire and footwear, as determined in VIV's sole discretion.
Equipment
You are expected to use all equipment as intended and return it to its proper place when finished. Some equipment may be reserved for group fitness classes, and you may be asked to move during certain times. You may not reserve equipment for personal use. As a courtesy to other members, please allow others to work in between sets and refrain from dropping weights unnecessarily. Direct equipment questions to a VIV team member.
Group Fitness Classes
Certain group fitness classes are included in your membership tier. Classes may require advance booking, and you may not be permitted to participate unless you have reserved your spot. You may book one (1) class per class category per day.
VIV may give away your reserved spot if you are not present at class start time. If you book through the VIV member portal or app, you may cancel a booking up to fifteen (15) minutes before the class starts. Failure to cancel or check in by the start of class will be considered a "missed" class.
If you miss three (3) bookings within a thirty (30) day period, you will be prohibited from booking classes online for a period of seven (7) days.
Walk-ins are welcome at VIV's discretion. Please avoid entering a class late or leaving early, as this is disruptive to others. Do not bring personal items that are not needed for class into studio spaces. Additional terms may apply to premium group fitness classes not included in your membership tier.
No Outside Trainers
Use of personal trainers who are not employed by VIV Athletic Club is strictly prohibited. You may not provide personal training services to, or receive personal training services from, any other member or guest, regardless of whether a fee is charged.
Personal Property
Please do not bring valuables onto Club premises, including jewelry, watches, and cash. Personal property, including gym bags, backpacks, purses, and coats, is not permitted on the Club floor or in studio spaces.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIV ATHLETIC CLUB WILL NOT BE LIABLE FOR THE LOSS OR THEFT OF, OR DAMAGE TO, ANY PERSONAL PROPERTY OF YOU OR YOUR GUESTS, INCLUDING WITHOUT LIMITATION ANY ITEMS LEFT IN LOCKERS, LOCKER ROOMS, RECOVERY ROOMS, STUDIOS, OR ELSEWHERE IN THE CLUB.
Parking
Where parking is available, it is provided solely for your benefit and convenience. Please do not leave valuables in your vehicle.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIV ATHLETIC CLUB WILL NOT BE LIABLE FOR THE LOSS OR THEFT OF, OR DAMAGE TO, ANY PERSONAL PROPERTY LEFT IN YOUR VEHICLE(S) OR THE VEHICLE(S) THEMSELVES.
Service Animals and Pets
Service animals individually trained to perform tasks for individuals with disabilities are permitted to accompany members or guests with disabilities in all areas of the Club open to members. VIV may ask you to remove your service animal if it is out of control, not housebroken, poses a direct threat to the health or safety of others, or fundamentally alters the nature of the Club's operations. VIV reserves the right to charge you for any actual damage caused by your service animal. Service animals must remain under the member's control at all times and may not be affixed to any Club equipment.
For the safety of our members and animals, pets and "emotional support animals" are not permitted in any area of VIV Athletic Club.
Responsibility to Notify
If an incident occurs at the Club, please notify a VIV team member as soon as possible so the matter can be documented and addressed appropriately. Where feasible, notice should be provided within twenty-four (24) hours of the incident.
GUESTS & CHILDREN
Guests
As part of your membership, you may receive certain privileges to periodically bring a guest to the Club. You must accompany your guest at all times. All guests are required to check in at the front desk, present valid photo identification, and sign a Guest Waiver in order to access and use the Club. Guest access is subject to all VIV Policies and may require payment of a guest pass fee.
VIV reserves the right to: (1) limit the hours available to guests; (2) limit the number of times any individual may access VIV as a guest; and (3) prevent any individual from accessing the Club as a guest. Guests under the age of sixteen (16) are not permitted.
Children
Children who are at least sixteen (16) years of age may use the Club as a guest. Children fifteen (15) years of age and under are not permitted to access any area of the Club, including locker rooms and equipment, unless they are participating in children-specific programming offered by VIV.
Parents or legal guardians will be required to sign a waiver and release form on behalf of any child before the child participates in programming or uses the Club as a guest. Children aged sixteen (16) or older are required to show identification with proof of age. VIV reserves the right to maintain a photo or copy of a child's identification on file.
All youth programs are provided as a convenience while you are using the Club. You are strictly prohibited from leaving Club premises while your child is in a youth programming area unless otherwise expressly permitted by VIV. Outside of supervised programming areas, children must be accompanied by a parent or legal guardian at all times. Any child who is disruptive, unsupervised, sick, or otherwise interfering with Club operations may be prohibited from participating in programming.
ANCILLARY SERVICES
Services Rendered by VIV
Purchases of personal training, nutrition counseling, and other sessions (collectively, "Sessions"), as well as any recovery or wellness treatments (collectively, "Treatments"), constitute the purchase of services provided by VIV Athletic Club — not by any particular trainer, instructor, or therapist. VIV may change or substitute your trainer, instructor, or therapist at any time. If you have specified a preference and VIV is unable to accommodate it for the scheduled time, VIV will work with you to reschedule or, if needed, cancel your Treatment.
Interactions & Expectations
Sessions and Treatments are voluntary activities in which you may elect to participate. You understand and acknowledge that personal training and recovery services may require close contact, and your trainer or therapist may need to make physical contact to provide adjustments and guidance. You may end your Session or Treatment at any time if you feel uncomfortable. If you have concerns about how a Session or Treatment was conducted, please raise them immediately with a VIV team member.
Discounts
VIV may offer certain discounts for purchasing multiple Sessions and/or Treatments as a package. Any discounts apply only to the number of Sessions and/or Treatments included in the package. Additional Sessions or Treatments beyond the package will be charged at the then-current individual rate.
Personal Training & Nutrition Counseling

Session Eligibility: Sessions are available only to active members.

Session Payment: Payment is required on or before the date of the Session. VIV may cancel any scheduled Session for which no payment has been received within twenty-four (24) hours prior to the Session. If you use a Session that was not paid for, VIV will charge the payment method associated with your account.

Session Cancellation Policy: You may cancel or reschedule a Session up to twenty-four (24) hours before the Session is due to start. You will be charged the full cost of the Session if you cancel or reschedule with less than twenty-four (24) hours' notice or fail to show up. No refund or reinstatement will be provided for late-cancelled or missed Sessions.

Expiration of Sessions: All Sessions expire upon termination of your membership or six (6) months after the date of purchase, whichever comes first, unless prohibited by law or a different expiration date is expressly stated in writing by VIV.

No Refunds: All sales of Sessions are final and non-refundable, except as required by law. Sessions have no cash value and are non-transferable and non-descendible. Sessions may only be used during the term of your active membership. Fitness results vary by individual; specific results are not guaranteed.
Recovery & Wellness Treatments
VIV Athletic Club offers recovery and wellness services including access to red light therapy, hyperbaric oxygen chambers, and other recovery modalities (collectively, "Treatments").

Treatment Eligibility: Treatments are available to active members aged sixteen (16) and older and to non-members aged eighteen (18) and older. Members under eighteen (18) must have a parent or legal guardian who is also a member, have such parent or guardian execute all required waivers, and be accompanied by such parent or guardian at all times during the Treatment.

Booking and Payment: You may be required to provide payment information to book a Treatment. You must check in at the front desk prior to your Treatment. VIV will charge the payment method on file for the Treatment at the time of the appointment.

Treatment Cancellation Policy: You may cancel or reschedule a Treatment up to twenty-four (24) hours before the scheduled start. You will be charged the full cost of the Treatment if you cancel or reschedule with less than twenty-four (24) hours' notice or fail to show up. No refund or reinstatement will be provided for late-cancelled or missed Treatments.

MEMBERSHIP FREEZES
Freezing Your Membership
You may temporarily suspend ("Freeze") your membership if you are medically unable to use the Club or for another statutorily required reason as described in your Membership Agreement. VIV may require documentation before approving a Freeze request. Memberships must be frozen in 30-day increments (a “freeze period”) and cannot exceed 90 days (a “maximum annual freeze period”). During any freeze period, all terms of the Agreement continue in full force and effect, including the member’s payment obligations. A monthly administrative fee of $25.00 will be assessed for each month during the freeze period. The effective date of any freeze or cancellation requested shall be 30 days from VIV Athletic Club’s receipt of written notice or email from the member. Following a freeze period, your term membership expiration date will be extended by the total amount of days that your membership was frozen.

Documentation
For certain Freeze requests, VIV may require a signed letter from a licensed physician, physician assistant, advanced practice registered nurse, or another credentialed medical provider. Other forms of proof may be required depending on the nature of the Freeze request.
Exclusions
You are not eligible to Freeze your membership if you have a past-due or overdue balance, your membership is not in good standing, you joined as part of a payroll-deducted or subsidized corporate membership program, or you hold a short-term membership.
How to Request a Freeze
You may request a Freeze by visiting the front desk in person or by emailing info@vivathleticclub.com. Please note: retroactive Freezes are not permitted.
Ancillary Services Not Frozen
Expiration dates for personal training sessions and recovery treatment packages are not suspended during any Freeze period.
No Use of the Club During Freeze
Members are prohibited from accessing or using the Club while their membership is on Freeze (other than any areas or services open to non-members). If you check in to the Club while on Freeze, VIV may revert your membership to active status without further notice, and a prorated amount of your membership dues will be added to your account.
COMPLIMENTARY ITEMS
As a benefit of your membership or from time to time, VIV Athletic Club may provide complimentary or promotional items, including personal training sessions, recovery treatments, membership credits, or other member rewards (collectively, "Complimentary Items").
Complimentary Items are offered at VIV's discretion, have no cash value, and are non-refundable, non-transferable, and non-descendible. Complimentary Items expire ninety (90) days after the date of issuance, unless otherwise stated in a voucher or written terms. All applicable VIV Policies — including booking and cancellation policies — apply to the use of Complimentary Items.
Credits or member rewards may be used to purchase ancillary services and eligible retail merchandise but may not be applied toward membership dues or any other excluded purchases. Complimentary Items may only be redeemed while you are an active member in good standing and will become null and void upon cancellation of your membership. Complimentary Items will not be considered in computing any refund upon membership cancellation.
PRIVACY & COMMUNICATIONS
Privacy Policy
VIV Athletic Club uses the personal data collected through the course of your membership, your access to and use of Club facilities, and your use of www.vivathleticclub.com and the VIV member portal to fulfill our commitment to providing an exceptional member experience. Please review our Privacy Policy, available at www.vivathleticclub.com/privacy, to understand our privacy practices, including the types of personal data we collect, how we use it, and with whom we share it. We may update our Privacy Policy from time to time and encourage you to review it periodically.
Video Surveillance
Members, guests, vendors, and visitors should be aware that VIV Athletic Club may capture images and video, including CCTV footage, within the Club to help maintain a safe and secure environment. Such footage is not shared with members, guests, or external parties except as required by law, pursuant to a subpoena or law enforcement request related to an active investigation, or as set forth in VIV's Privacy Policy.
Marketing Communications
VIV may use your personal data to provide you with special offers, promotions, and information about VIV Athletic Club and our services. Where required by applicable law, we will obtain your consent before sending marketing communications.
If you do not wish to receive marketing emails, you may opt out at any time by clicking the unsubscribe link in any marketing email or by contacting us at info@vivathleticclub.com. Please note that even if you opt out of promotional communications, you will continue to receive administrative and operational communications regarding your membership, such as billing notices or Club updates.
